Terms of Service

These Terms of Service (“Terms”) govern access to websites and services operated by GomezTek (“we,” “us,” “our”), including gomeztek.com, mesaos.com, demos, and MesaOS software and related APIs (collectively, the “Services”). By using the Services, you agree to these Terms. If you use MesaOS for a business, a Merchant Agreement may also apply and controls if there is a conflict on commercial terms. Our Privacy Policy explains data practices.

1. Eligibility

You must be at least 18 and able to form a binding contract. If you accept for a business, you represent you have authority to bind it.

2. Accounts and security

You are responsible for credentials, staff access, and activity under your accounts. Notify us promptly of unauthorized use. We may suspend accounts for security risk, abuse, non-payment, or Terms violations.

3. Acceptable use

You may not: (a) violate law or third-party rights; (b) probe or attack our systems; (c) scrape without written permission; (d) upload malware; (e) send unlawful spam; (f) process fraudulent transactions; (g) reverse engineer the Services except where law forbids that restriction; (h) use the Services to build a competing product using non-public aspects of our software; or (i) misuse AI features to generate unlawful, infringing, or deceptive content.

4. AI features

Optional AI tools (e.g. Kitchen Setup, Product Coach, Assistant) generate suggestions only. You must review before applying. AI output may be inaccurate, incomplete, or inappropriate. AI is not legal, tax, dietary, allergen, or professional advice. You are solely responsible for decisions and content you apply. We disclaim warranties regarding AI accuracy. Do not submit card numbers, passwords, or unnecessary sensitive personal data into AI prompts. Use of AI may involve third-party model providers as described in the Privacy Policy.

5. Cookies and tracking

We use cookies and similar technologies as described in the Privacy Policy (essential session/security cookies and analytics). By using the websites, you consent to essential cookies required for operation. Where required, additional consent mechanisms may apply.

6. Demos and beta features

Demo environments and beta/preview features are provided as-is for evaluation, may contain test data, may be reset, and may change or end without notice. Do not put production secrets or real card data into demos unless we expressly instruct otherwise.

7. Hardware

Starter hardware, if provided, is typically a lease owned by GomezTek/MesaOS, not a sale, and is governed by the Merchant Agreement and any Order. Title does not pass to you unless an Order expressly says so.

8. Intellectual property

We and our licensors own the Services, branding, and content we provide. We grant a limited license to use the Services as permitted. Feedback may be used by us freely. You retain ownership of content you lawfully upload; you grant us rights needed to host and process it to provide the Services.

9. Third-party services

Integrations (e.g. Stripe, Square, delivery platforms) are subject to those providers’ terms. We are not responsible for third-party outages, fees, or policies.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOMEZTEK AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100. SOME JURISDICTIONS LIMIT THESE EXCLUSIONS; THEN OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED.

12. Indemnification

You will defend and indemnify GomezTek and its affiliates against claims arising from your use of the Services, your content, your violation of these Terms or law, or disputes with your customers or staff—except to the extent caused by our willful misconduct.

13. Termination

We may suspend or terminate access for breach, risk, or non-payment. You may stop using the Services at any time. Survival: IP, disclaimers, liability limits, indemnity, and governing law.

14. Governing law

California law governs, excluding conflict-of-law rules. Exclusive venue: state or federal courts in California. You consent to personal jurisdiction there. Class actions and jury trial are waived to the extent permitted by law.

15. Changes

We may update these Terms by posting a new version. Continued use after the effective date is acceptance. If you disagree, stop using the Services.
